Terms of Service

These Terms of Service (hereinafter referred to as the “Terms”) set forth the conditions for the use of the services (hereinafter referred to as the “Service”) provided on this website by Aki Mata Suisan Co., Ltd. (hereinafter referred to as the “Company”). All registered users (hereinafter referred to as “Users”) shall use the Service in accordance with these Terms.

Article 1 (Application)

  1. These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.
  2. The Company may establish rules, guidelines, and other provisions related to the Service in addition to these Terms (hereinafter referred to as “Individual Terms”). Regardless of their name, such Individual Terms shall constitute part of these Terms.
  3. If any provision of these Terms conflicts with the provisions of the Individual Terms, the Individual Terms shall prevail unless otherwise specified.

    Article 2 (User Registration)
  4. To use the Service, applicants shall agree to these Terms and apply for registration in the manner prescribed by the Company, and registration shall be completed upon approval by the Company.
  5. The Company may refuse registration if it determines that any of the following applies, and is not obligated to disclose the reason:
    a. False information is provided in the application
    b. The applicant has previously violated these Terms
    c. The Company otherwise deems the registration inappropriate

    Article 3 (User ID and Password Management)
  6. Users shall properly manage their User ID and password at their own responsibility.
  7. Users shall not transfer, lend, or share their User ID or password with any third party. The Company shall deem any login using a matching ID and password as use by the registered User.
  8. The Company shall not be liable for any damages caused by unauthorized use of User ID and password unless due to willful misconduct or gross negligence of the Company.

    Article 4 (Fees and Payment)
  9. Users shall pay the fees for paid services as separately determined by the Company and displayed on the website, using the method designated by the Company.

    Article 5 (Prohibited Activities)
    Users shall not engage in any of the following acts:
  10. Acts violating laws or public order and morals
  11. Criminal acts or related activities
  12. Infringement of intellectual property rights contained in the Service
  13. Acts that damage or interfere with servers or networks
  14. Commercial use of information obtained from the Service
  15. Acts interfering with Service operation
  16. Unauthorized access or attempts thereof
  17. Collection or accumulation of personal information of other Users
  18. Use of the Service for improper purposes
  19. Acts causing disadvantage, damage, or discomfort to other Users or third parties
  20. Impersonation of other Users
  21. Unauthorized advertising, solicitation, or sales activities
  22. Acts intended for dating with strangers
  23. Provision of benefits to antisocial forces
  24. Other acts deemed inappropriate by the Company

    Article 6 (Suspension of Service)
  25. The Company may suspend or interrupt the Service without prior notice in the following cases:
    a. Maintenance or updates of the system
    b. Force majeure such as natural disasters or power outages
    c. System or communication failures
    d. Other cases where the Company deems continuation difficult
  26. The Company shall not be liable for any damages resulting from suspension or interruption of the Service.

    Article 7 (Restriction and Cancellation of Registration)
  27. The Company may restrict use or cancel registration without prior notice if the User:
  28. Violates these Terms
  29. Provides false information
  30. Fails to pay fees
  31. Does not respond to Company communications
  32. Has not used the Service for a certain period
  33. Is otherwise deemed inappropriate
  34. The Company shall not be liable for any damages resulting from such actions.

    Article 8 (Withdrawal)

    35. Users may withdraw from the Service by following the procedures specified by the Company.

    Article 9 (Disclaimer)

  35. The Company does not guarantee that the Service is free from defects (including safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors, bugs, or infringement).
  36. The Company shall not be liable for any damages arising from the Service, except where it constitutes a consumer contract under applicable law.
  37. Even in such cases, the Company shall not be liable for special damages and shall limit liability to the amount of fees received in the month the damage occurred, excluding gross negligence.
  38. The Company is not responsible for disputes between Users or third parties.

    Article 10 (Changes to Service)

    39. The Company may change or discontinue the Service without notice and shall not be liable for resulting damages.

    Article 11 (Changes to Terms)

    The Company may modify these Terms without notice. Continued use of the Service constitutes acceptance of the revised Terms.

    Article 12 (Personal Information)

    Article 13 (Notices)

    Notices between Users and the Company shall be made via methods specified by the Company. Unless otherwise notified, registered contact information shall be deemed valid.

    Article 14 (Prohibition of Assignment)

    Users may not assign or pledge their rights or obligations under these Terms without prior written consent from the Company.

    Article 15 (Governing Law and Jurisdiction)

  39. These Terms shall be governed by the laws of Japan.
  40. Any disputes shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Company’s head office location.
